Civil Disobedience & Evolution Author- Rev SC Raven 2004© In the late 21st century the basic needs and interests of an existing trend expanded the choices victims face. Private prosecutions of victims grow with the servers of the public prosecutor arenas. As this gap widens between the popular, privileged citizens, as appose to the more silent “broom closet” citizens complaints are handled by internal agencies. The fixation on “getting even”, revenge over looks a countercurrent that is gaining strength. The efforts underway to invent and explore approaches that can peacefully resolve conflicts which fuel interpersonal violence in any range. For decade’s leaders, teachers, advocates, judges, and community administrators have weeded out what is called “drama”. Garbage so do speak from their offices, presuming the citizens will automatically agree to what they consider to be drama, junk, garbage, or humor. What they deemed as junk, wastes of time, that did not merit as public attention in a positive light were drawn forward as meriting much public attention by citizens, involved people before they became embroiled in disputes which one or both parties share the responsibility for the outbreak of hostilities. One can only dream that by the end of this decade if not the century; interests would grow in constructive, effective ways of handling circumstances of dangerous citizens without removing them from our society. In our modern society in 1978, Indiana the first victim-offender reconciliation program was established. By 1990 the National Institute of Justice was encouraging restorative justice that promised to involve victims and community activists in the process of repairing any and all harm caused by an individual or groups. Now the Resource center has expanded from 100 centers to 2000 centers across the United States. Our communities in our underground Society should inspire by their own ethical personal teachings that any crime symbolizes a wound, infliction that afflicts the entire community, and must be healed of their emotional wounds as well as their personal place within the society. To heal these inflictions, both the victim and the perpetrator need to be empowered through their own spirit. Especially with those citizen complaints which label citizens as either “totally innocent” or “completely guilty of the said crime”. The society underground has stability to its foundations, which is stronger in many ways than our modern counterpart society. Citizens are primarily practitioners of Magick, or are scholars of the avenue of Magick, which is how we have come to have a society. Those citizens follow a code of ethics, which are similar in many circles. Centers throughout the virtual communities as well as offline citizen organizations, for assistance in these scenarios must control each resource center for he citizens through a form of mediation. Those who can objectively govern both sides of the said case renovate to rebuild broken bridges of communication, personal placements within our own society. The final step is the leap of objectionable to positive reconciliation to the communities affected initially by the hostilities. This significant spiritual restoration of justice nurtures a whole atmosphere throughout our society of forgiveness, redemption, acceptance, tolerance, and harmony. As predicted in past commentaries the opportunity, rights, and privileges available to victims will be buried. Differential justice will become more blatant. Those hostile situations will be resolved only upon the determination of the ‘victims’ status verses the ‘offenders’ place in the social order. Victiminazations of citizens will continue to a serious system of harming one another. “When the meager possessions of a marginal member of society are stolen, identities marked, when they are beaten, threatened, and our children are at risk, the same old assembly line of “leaders” will dispose of the rhetoric as “drama” will evolve again” Community- Oriented Policy Philosophy A community policy is a philosophy of concepts which citizens work together in creative ways to help solve community problems. The philosophy is predicated on the belief that achieving these goals require that a new relationship with the majority of our community allow a greater voice in setting and involving efforts to improve the overall quality of life for newcomers, teachers, and established organizations within the society Community policy should be aimed at problem solving and focusing on the results. The techniques are problem identification, problem analysis within a reasonable time frame and problem resolution. The policy needs to organize citizen input in matters that involve safety. Citizen partnerships and power sharing with established organizations must be implemented to control everyone’s effort for actions and results. Community Influence Members of our underground community have legitimate ideas about what they want and need. Members have pertinent information about problems and people in their specific areas and organizations. Leaders, teachers, Organization founders, as well as citizens each hold a stereotype about others. Unless these stereotypes are broken down by non-threatening contacts, it will prevent many groups from making effective use of a united community. The need for effective methods for a united underground society is to listen to the community citizens. Including those who have no particular ties to one organization or another, but participate in many concurrent forums. One way to achieve this is to create a mass community poll and allow email or forum feedback related to the poll. The poll must include questions pertaining to victims, witnesses, to rate community leaders on areas of concern, helpfulness, knowledge, quality of service, solving the problem, putting the member at ease Based on these mass community polls community citizens, members, and leaders can make adjustments and improvements in our actions. A forum board created specifically for a “neighborhood information network” would be a direct source of crime information in our society. Using a forum specific to this, will improve by the release of accurate information pertaining to our society to inform members of crimes committed and provide prevention techniques including the use of a poll to help other citizens of our community avoid becoming victims themselves. The accuracy of information will replace the ever so damaging rumors, gossip, and accounts of slander. Practitioners have come to realize that traditional approaches to crimes against members of our underground society have not worked and the development of a new strategy is imperative. The driving force behind this is the desire to maintain the quality of life for citizens of our society as well as our parallel modern society. The structure requires “leaders” to be more flexible and democratic. Instead of being incident driven any longer, the community must emphasize community problem solving to honor each member independently as well as collectively. Society exists in a changing world our society is no different. Society of 20th century is different from that of today. The age of information has taken hold. We are able to communicate in more ways with anyone in the world instantaneously. Our strategies need to change with over all society. Democratic Edge The democratic rule of law in our parallel modern society is a rule of law process, which means a government of laws not men. In our society we must be diplomatic by creating a community process of intervention, and prevention of crimes by policy not attitudes and gossip. Community members must assist in the policy itself as well as mobilizing the community to accomplish the task. Our Underground Society and Modern Laws Modern laws are dictated in the US by the Constitution. It is the framework for protection of individuals from an unwarranted intrusion of our daily lives. The Bill of Rights guards our personal integrity, which gives us the right to be left alone. Our modern government is the only physical force over us. Therefore in our society the right to be left alone, means above all the right not to be punished for what we have said or done except for clearly specific scenarios. First Amendment “Congress shall make no laws respecting an establishment of religion or prohibiting the free exercise thereof; or a bridging the freedom of speech, or of the press, or the right of people peaceably to assemble and to petition the government redress of grievances” The US Supreme Court has held all speech to be constitionally protected except for speech that is pornographic, inciting a riot or rebellion. The Supreme Court has no problem with imposing sanctions because of the bias of the perpetrator toward a targeted group or person. In New Jersey in 1971 the importance of victims in the criminal and civil justice equation was born. New Jersey established the Violent Crimes Compensation Board (N.J.S.A. 52:4B-3) An administrative body was granted authority to compensate victims for personal injury or death resulting from crimes. In 1985, New Jersey adopted the Crime Victims Bill of Rights (N.J.S.A. 52:B-46) a statutory enactment. It simply clarifies the rights of victims to be notified of various critical stages of the process as it relates t the defendant. It also allows the preparation of a statement to be included in a report. The legislature adopted a statue allowing victims to file a written statement about the impact of the crime on the family, home and work lives, which also became permitted in personal non-capital cases. (N.J.S.A. 52:4B-36(m)(n)) In 1995 adoption of the Victim Impact Statue was approved by 85% of the voters in 1991 which provides crime victims be treated with dignity and respect. In our society victim testimony needs to be carefully reviewed in advance. Statements would be de-voided of emotional outbursts and neither party could address issues of each person’s character. Comments would be limited solely to the character of the victim and the impact of his or her loss. Lastly references to the worth of the victim or accuser would not be tolerated. Technological Society At the present time all societies need to realize that the use of one computer network, the Internet estimates 15 million people in 50 countries are connected. Nearly 85% of personal computers have modems facilitating the transmission of messages. The electronic world of computing operates rain or shine, day or night, in any place; home, car, office, airplane, satellite, as well as within National and International jurisdictional lines. Advanced users of the Internet can provide easy access and user-friendly environments for any wrongdoing. Not only can hackers disrupt computer systems and enter cybernetic space unauthorized, but they can also run up incredible toll charges easily and quickly tapping systems. Societies need to realize that for several decades computers have been collecting, filling, and storing private details gathered from personal applications; such as DOB, eye color, height, weight, hair color, physical addresses, personal and business locations. Responses received from hostile environments on the Internet are local gossip, false or questionable reliability, and validity. If a person has no way of knowing this, it may enter the info banks as facts and cripple another’s livelihood. To delete false information is a long, tedious, costly struggle. Civil Disobedience is the act of disobeying a law on grounds of moral or political principle. It is an attempt to influence society to accept a particular point of view. The classic Treatise of Henry David Thoreau’s “On the Duty of Civil Disobedience” states that when a person’s conscience and the laws clash that person must follow their conscience. The need to act now as appose to waiting for changes are the result of recurring acts of civil disobedience. The US Bill of Rights states that whenever any form of government becomes destructive, it is the right and duty of the people to alter or abolish it. Gandhi profoundly influences this movement by quoting “non-cooperation with evil is as much a duty as cooperation with good”. Libel became more of a civil matter in the 19th century. Governments still continue to prosecute writers who used individuals to formulate libel and slander. However individuals began to take it upon themselves to file suit in courts to protect their own reputations. If you are unable to file suit for particular reasons, you were forced by the government to deal with the repercussions of your reputation being damaged. Minnesota legislature in 1925 passed a public Nuisance abatement law that permitted a judge to shutdown any publication that he deemed obscene, lewd, lascivious, malicious, scandalous, and defamatory. Soon after this abatement law the US Supreme court by a 5-4 vote put into place a Constitutional defense of the long-standing position based on English Common Law; and accepting the Founding Fathers, that there should be prior restraints to those who use the First Amendment as a means to damage, violate a single citizen, or a group of citizens livelihood based on an emotional outburst with no validation of a legitimate crime. Chief Justice Charles Evans Hughes majority opinion in this case “will go down in history as one of the great triumphs of free thought” In summary the media traditionally and modern internet have a history of testing the resilience of the Free Speech and Free Press clauses of the 1St Amendment. This is done by challenging any attempts to restrict their arguments by arguing that “the pubic has a right to know” is now, in the 20th century, being amended with limits that can protect the endangerment of the lives of children, families, social and employment welfare. Free Speech in any society does not translate to “bring as much harm as possible to any citizen that a family must suffer in their livelihood and futures”.
