Expungement and record sealing are important now more than ever. Within the past ten years, two major changes dramatically increased the need to have a clean past. First, the internet has made performing routine background checks easy, quick and affordable. Business owners and landlords alike routinely use the internet to unearth public information about potential employees or tenants. Second, the events on September 11, 2001 created a "new normal" for many larger public and private companies that may not have focused on background checks before, but now routinely check criminal records of potential employees or business partners in order to protect themselves from future liability. When you seal or expunge your record, your criminal history is no longer accessible to the public, plus you can lawfully deny the existence of a prior record, under most circumstances. Think of it as a second chance. While the benefits to having a clean record are many, the most common are: 1. Better Job Opportunities and Increased Earning Capacity: Having a criminal record closes the door on a substantial majority of job opportunities. Most private and public employers run background checks on potential employees or business partners, especially in higher paying positions. Even lower paying positions require that you fill out an employment application that, no surprise, asks if you have a record. Having a criminal record even will prevent you from obtaining certain professional licenses. Especially in these difficult financial times, having a clean record is necessary to increase your chances of getting a decent paying job, or any job at all. 2. Better Educational Opportunities and More Money For Education: Did you know that you can lose a scholarship if you have a criminal record? Or not get into the college, vocational program, or law school of your choice? In addition, many educational loan opportunities require that you disclose information about your criminal history on loan and aid applications. 3. Increased Loan and Housing Opportunities: With a clean record, you become eligible for housing assistance and greater private housing opportunities. Private landlords are not required to rent to people with a criminal history. Without a record, you also increase your chances of obtaining private loans. 4. Peace of Mind: One mistake should not haunt you for the rest of your life. Sealing or expunging your record allows you to leave the past where it belongs - in the past.
